Interesting Home Improvement Statistics | RTA Kitchen Cabinets

According to American Express? Spending and Saving Tracker, there are some interesting statistics about home owners and home improvement in general.?? According to their 2012 Home Decision Report, only about 10% of Americans plan on buying a new home or looking for a new home.?? Some of it due to housing market confidence, and others who think they will not get the value out of their home.? This doesn?t seem surprising to me, since most parts of the country had a significant drop in property values which hasn?t recovered yet.

What I do find interesting is the number of people who were planning renovations.?? Almost 70% of homeowners had home improvement plans, and were planning on spending an average of $3,500 which is up $100 from last year.? A low percentage of people buying, an increased number of homeowners remodeling, and an increase in average spending, means that homeowners are trying to add value to their owners because they are planning on staying in them longer (as we all know, the best value is in the kitchen? and $3,500 can you get you a spectacular kitchen if you buy our cabinets!)

The one statistic that I am happy to see is the percentage that are looking to do it themselves.?? 72% of homeowners plan on doing the work, with the primary source for their inspiration being home improvement shows (roughly 42% of people stated tv shows as the primary source).?? Being that we are the largest participant in kitchen renovations on HGTV and DIY Network, this is a stat that I am happy to hear!

No joke: Great performance can't save 'Idol'

Heejun Han delivered his best performance of the season Wednesday, but it wasn't enough to keep him in the competition.

The Heejun Han musical comedy tour ended on ?American Idol? on Thursday, ironically following his best solo performance of the season.

After weeks of getting not-so-subtle hints that he should cut back on the jokes, culminating with Steven Tyler?s less-veiled swipe a week ago, Han cut out the act and did a straight-up performance of Donny Hathaway's ?A Song for You.? It was sweetly done and earned him a standing ovation.

But Jimmy Iovine summed up the situation best in his Thursday video clip. He praised Han?s effort but noted, ?My problem is I don?t think he sings as well as the other eight contestants at this point in the show.?

And therein lies the paradox that characterized Han?s stint on ?Idol.? He wasn?t quite compelling enough of an entertainer to win in the Taylor Hicks style, and he wasn?t a good enough pure vocalist to take the title that way. Whatever he did was going to win him some support ? he definitely has a future in entertainment somewhere ? but not enough to win a competition like this one.

Even on his best night, he legitimately had one of the weakest performances because everyone else was at their best as well. Since the judges did not use their save to keep him around, Han finishes in ninth place and will have to pack his things just after he moved into the ?Idol? mansion. It will definitely be a less funny place without him around.

The more shocking news was that Skylar Laine was in the bottom three, along with Hollie Cavanagh, who deserved that fate. That means Laine will likely get the fawning from the judges that?s been reserved for Elise Testone?as they try to keep the star women on the show without having to use their save so early. Maybe it was divine payback for picking Miranda Lambert as her idol, considering Lambert's husband, Blake Shelton, works for "The Voice."

Of course, there are other female stars that the judges seem less eager to have hang around. Guest performer Nicki Minaj, for example. She asked host Ryan Seacrest if she could come back and be a guest judge, and while their mouths said ?any time? the body language and facial expressions said ?no shot.? Especially if Jennifer Lopez has a say. She did not look happy at the thought of a challenge. Simon Cowell has more of a chance at being invited to judge again than Minaj does.

Hitting the other end of the excitability meter was the Eric Benet cameo. He appeared briefly onstage to tell DeAndre Brackensick how much he appreciated the young man's cover of his tune "Sometimes I Cry" on Wednesday, and the ?Idol? hopeful reacted as if ?he?d won the lottery. Mariah Carey did not do the same for Joshua Ledet, but she did tweet that she liked his performance of "Without You." Stunningly, she did not mention having worked with Randy Jackson. Maybe that feedback loop works only one way?

Brackensick avoided the bottom three this past week, but he can?t rest easy. Given the unpredictability of the voting so far, the only sure thing is that with Han out, there will be less irreverence in the show next week.

With so many business scandals lately, there?s often a damning e-mail exposing wrongdoing, often sent by high-level employees.

Just last week, government officials investigating the collapse of MF Global released an email from the firm?s assistant treasurer that could implicate the CEO, former New Jersey Governor Jon Corzine.

The e-mail states: ?Per JC?s direct instructions? millions of dollars were transferred out of customer accounts to cover a shortfall at the defunct brokerage, an act that could spell legal problems for both Corzine and the treasurer.

E-mail evidence like this isn?t unusual. Last year, an investigation into phone-hacking charges at News Corp. unearthed damning e-mails that showed top managers were informed about widespread illegal activity. And even the Oracle-Google patent fight has a ?damaging e-mail? that is part of the saga. According to a recent article in Computer World, Google has been trying to keep an e-mail written by one of its engineers out of the case.

So, the question is, why do people keep putting potentially harmful information in e-mails? Sure, it?s great for prosecutors who want to expose malfeasance at companies, but after so many public e-mail faux pas you?d think people would have wised up.

One of the top reasons they haven?t is ?hubris,? maintained Dave Scher, an employment attorney with the Employment Law Group. ?People think they?re above the law.?

Scher represents employees in cases of retaliation or discrimination at work, and with about half of his cases he?s able to find e-mails that corroborate or confirm retaliatory or discriminatory conduct.

One of the most blatant e-mails came from a boss who was pretending to be a licensed therapist. When his employees exposed him, the manager sent the worker an e-mail basically stating he was firing him because he revealed his lie. It was a retaliatory move that?s illegal under labor laws.

Indeed, about a quarter of companies have had an employee e-mail subpoenaed as part of a lawsuit or regulatory investigation; and 9 percent ended up in court because of an employee e-mail, according to the most recent report on business communications policies by the American Management Association and The ePolicy Institute. This is despite?that about 80 percent of organizations have written e-mail policies, the study found.

Stephanie Weiland Knarr, a licensed psychotherapist from Laurel, Md., isn?t surprised that people who engage in shady acts have no qualms about letting it all hang out on e-mail. ?The personality type of someone who is engaging in illegal behavior is often narcissistic,? she explained, adding that they think they?re invisible and above the law. ?These types of people like to take risks and even if they?re caught and the writing is on the wall, so to speak, they still deny it.?

What may also be driving some of this is that many employees just don?t take e-mail seriously, surmised Nigel Cannings, technical director for Chase Information Technology Services, a London-based firm that does corporate compliance.

?What we have found is that people just don't think of e-mail as ?real,?? he explained. ?To them it's an ephemeral thing that is sent off into the ether, and which is a) private, and which b) can be deleted. Usually, both are untrue.?

Indeed, in most cases you can?t just scrub your e-mails away if you realize they could be career killers, or land you in legal hot water.

?Depending on industry and the size of an organization, e-mails are immediately written to an enterprise repository, which is accessible by legal and compliance functions. And which cannot be deleted, even if they are deleted from the e-mail client,? Canning noted.

And, he added, ?Financial regulators insist that e-mails are maintained for potential later investigation. Increasingly this is the case for IM messages as well, and they are likely to be the next big area where people get caught out.?

It?s not just illegal deeds that are exposed via e-mail. Patti Johnson, a career expert and the CEO of PeopleResults, said the e-mail flubs she sees most include:

  • The misinterpretation: ?E-mails are often misinterpreted because you wrote it quickly, used the wrong tone or copied the world. A poorly worded or quickly written e-mail can send the relationship in a downward spiral because it is misinterpreted.?
  • The misused CC: "This is often the equivalent of saying I need to let your boss know because I'm not sure you will get it done, or I need someone else to be involved. Use the CC with intent or you can end up with a trust issue on your hands unintentionally.?
  • The address mixup: ?E-mails sent to the wrong person. Yes, it happens and it isn't pretty. You type the person's name in you are complaining about.?
  • The angry: ?E-mails sent when you're mad. This is time to take a deep breath and make sure you have the facts and pause. A good rule of thumb is if you are going to send a flaming e-mail out, sleep on it first or at least walk around the block. Because once it goes - you can't get it back.?

In the end, e-mails are ?permanent and very, very mobile,? stressed Margaret King, director of a consumer research think tank, The Center for Cultural Studies & Analysis.

?Never put anything in an e-mail that you would not want quoted in the New York Times,? she advised. ?If the material is that sensitive, ask the recipient to give you a call, and transmit that way.?

Family members' financial responsibility for elder care costs incurred ...

Particularly with the facts stated below, does a rehab center/nursing facility have the legal right to (try to) obtain payment from the family members of a patient who had passed away, when the situation is such that the family members have no legal financial responsibility for that patient?s affairs or debts?

1) Remaining rehab Medicare co-payment costs incurred (prior to patient?s transfer to the hospital where she expired) were billed to Medicare and paid out by Medicare at an 80% coverage rate.
2) At no time did any family member have a Power of Attorney in affect to handle patient's affairs.
3) Also, no family members signed any type of Rehab/Nursing Facility "Admission Agreement Form" nor did any family members signed any other forms/documents of any type, and as such, no family member is legally financially responsible for patient's debts incurred nor for handling the debts on that person?s behalf (since there is no POA).
4) The patient, not family members, while alive was financially responsible (out of only the patient's own assets) for remaining 20% Medicare co-payment costs.
6) The patent had listed one of her children on a health care proxy while at the rehab center, which, while the patient knew that her child was aware of her wishes, the child was not present for, never saw or signed the form, nor was presented with a copy of by the rehab center until after the parent was at the hospital and was in the early stages of passing away. It is on this health care proxy form that the child?s address was previously provided by the patient for only that reason, and which is where the rehab chose to obtained and utilize the child?s address from for purposes other than the intended purpose of needing an address on a health care proxy.
5) The patient?s children were not joint on any accounts of their elderly parent. They were only listed as beneficiaries for the checking & savings account, and also as beneficiaries on her small (only a few thousand dollar) life insurance policy.
6) The total funeral costs exceeded the total of the life insurance policy amount combined with the total amount of remaining assets which were left in the patient?s bank account prior to her passing.
7) The patient arrived at a rehab center in February from a local hospital and the rehab had received what is called a "Face page" containing the patient?s relevant medical condition/status. The rehab was advised and apprized at that time by family members to obtain any other pertinent financial and medical info, particularly regarding the patient?s Medicare coverage from the other rehab facility that she was at prior to going to the hospital. The new rehab center was made fully aware of the patient's financial information a few days after arrival, at which time any and all available information requested had been obtained & provided (by the patient and family members) to the rehab center since they needed that info as they were handling the filling out & submission of the Medicaid application. This included the rehab having received the patient's bank account statements through the end of the preceeding month. The rehab also knew that the patient only had two sources of monthly income - her one and only pension amount and social security, both of which were direct deposited into her checking account, and for which the rehab was made aware of those actual amounts as well as account balance. As such, the rehab had the information about the patient's financial status and were cognizant of what little monies she had available.
8) The patient passed away passed on Tuesday, 3/20/12.
9) The death certificate was provided to the patient?s family members from the funeral home on Thursday, 3/22/12.
10) The death certificate was provided to patient?s bank the same day (3/22) by the patient?s children (i.e. beneficiaries).
11) The bank stated to beneficiaries on 3/22 that there was a required "waiting period" of up to 5 -7 days. The patient?s beneficiaries were led to believe that was necessary for the purpose of ensuring that there were no liens or outstanding debts for which the bank would have been legally bound to hold back and/or not release monies from the patient?s account to the beneficiaries.
12) Funeral home expenses were incurred from the date of the patient?s passing (3/20) thru the date of burial, which was Friday, 3/23.
13) The bank called the beneficiaries on Monday, 3/26/12 and let each of them know that the monies in the patient?s account had cleared and were available to be released to beneficiaries.
14) Despite the rehab having been verbally apprised as well as having been presented with written information in the form of copies of documents, and thereby aware of all of this, and despite them having already been told that the patient?s children did not have POA for the patient?s affairs, the rehab still, for whatever reason, chose to send a statement for the patient's account to one of her children where they lived.
15) The rehab generated this statement dated 3/22/12, after the patient?s date of death, and was not received until after 3/27/12, after monies had cleared with and released from the bank.
16) Medicaid kicks in after the first 100 days of Medicare coverage ends. Info required for the Medicaid application was provided to the rehab in February (several days after patient?s arrival) in order for the rehab?s social worker and/or business office to fill out & submit the Medicaid application on the patient?s behalf (so that the rehab center themselves could take steps to ensure eventually getting paid from Medicaid retroactively from Day 101 & onward in the event that the patient were to have gone back to the rehab center). The amounts reflected on the rehab?s statement are for Medicare co-payments for all days at that rehab which were under the first 100 days of Medicare. For Medicare purposes, the patient spent Day# 63 thru Day# 100 at that rehab before going to the hospital where she subsequently expired.
17) There is an asset level of I believe to be $13,800, under which Medicaid allows for one to retain for personal living expenses and for funeral & burial costs that are incurred when one passes away. I have been led to believe that Medicaid generally does not typically ?go after? monies below that level. However, I?m not sure if that is also the case when it comes to Medicare considerations with respect to allowable remaining assets for living & funeral/burial expenses vs. debts incurred while alive as it pertains to Medicare co-payment amounts incurred.

  • If Medicare co-payment costs were incurred by an elderly patient at a rehab center (of which Medicare paid 80%) prior to that person passing away, and the Medicare co-payment costs were not billed until after the date of death, and the patient?s monies had cleared with the patient?s bank for release to beneficiaries (after having presented a death certificate to the bank) for the purposes of and in order to pay for funeral expenses of the patient, since the beneficiaries did not have POA, and were not legally handling the patient?s financial affairs, and were also not legally financially responsible for patient's debts, then is there any means by which a rehab center can still somehow legally obtain payment from what had been the patient's monies (which had been in the patient?s account prior to his passing), despite the bank having allowed the required number of days for monies to clear before releasing those monies to the beneficiaries?
  • And if so, does the rehab have a legal right to now, after release of those monies to beneficiaries, obtain seeking payment (partial or otherwise) from each of the patient?s beneficiaries (by even possibly trying to seek placing a lien on a beneficiary's house) despite the fact that there were also known legitimate funeral expenses that were also required to be paid from the patient's assets, and despite the fact that the beneficiaries were not legally/financially responsible for the patient's debts?
The total cost for funeral home & burial services exceeded the amount of monies in the patient's account and life insurance combined. Since it is general knowledge and understood as a known and acknowledged fact that there are expected funeral & burial expenses when one dies, it is therefore understandably reasonable and anticipated that those funeral costs would be paid from the patient's assets (and NOT that other debts incurred when the patient was alive would somehow get first priority/consideration for payment, which would thereby consequently result in family members to inappropriately be erroneously expected to have to bear the cost of funeral & burial, especially when the purpose and intent of advising the patient while alive to try to have some minimal amount of monies left in the patient?s account, combined with whatever small amount of life insurance, would go towards trying to cover all of the customary funeral & burial costs).
  • In light of all of the above regarding funeral expenses paid from patient's assets as well as consideration of family members not being legally financially responsible for patient's debts, does a rehab (still) have a legitimate legal leg to stand on with this matter in so far as to subsequently trying to seek payment for family members, particularly since the rehab has already gotten paid by Medicare for 80% of the patient's costs incurred?
